'WASHINGTON (CNN) -- A "fear of death" prevented John Walker Lindh from leaving his Taliban unit after the September 11 attacks on the United States, his lawyers argued in court papers Friday.

Documents filed in a federal court in Virginia offered the first glimpse of the strategy Walker Lindh's attorneys plan to use against government claims that the 21-year-old Californian conspired to kill U.S. nationals. Walker is accused of joining Taliban and al Qaeda forces and continuing to ally himself with them after learning of the terrorist attacks on the United States.

"The December summaries, for example, report that Mr. Lindh was obviously disillusioned when he learned of the attacks on the World Trade Center and wanted to leave his Taliban unit, but could not do so for fear of death," defense attorney George Lewis wrote in Friday's court filing.'

This is one I'll have to reserve judgement on. All we know is what is allowed in the media and that sometimes is a very tainted view fo the facts. He should not become the scapegoat for all the fears and anger of the tragedies of 9/11 but he won't have a normal life in America ever again....even if given full pardon and release.

I can understand being in fear for his life if showing any feelings of remorse for 9-11. I also understand that his passport says specifically that he couldn't fight with anyone else's armed forces. I say ship him back. He has more of a chance of living if he's set free there.

Oh no!!!!!!!! he is a traitor to this great country of ours. Many of my brothers have given their all fighting against the very cause he stood for. Once the hand is caught in the cookie jar he wants to sing to a different tune huh? I say bring his ass home , put him up for treason, and let the military take it from there. We could always use some good targets on the sniper range.
